By accessing or using the MyEVCred website located at myevcred.com (the "Site") or the EV Tax Credit Calculator (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or Service.

These Terms apply to all visitors, users, and others who access or use the Service, whether located in the United States, the European Union, the United Kingdom, Canada, or anywhere else in the world.

2. Description of Service

MyEVCred provides a free, web-based calculator tool that allows users to estimate potential state rebates and federal tax credit eligibility associated with the purchase of new or used electric vehicles (EVs) in the United States. The Service includes:

• A federal EV tax credit estimator based on IRS §30D (new EVs) and §25E (used EVs) under the Inflation Reduction Act (IRA)
• State-level rebate reference information for US states
• Informational content about US EV incentive programs, eligibility requirements, and program descriptions
• State-specific landing pages with local EV incentive details

The Service is provided free of charge and without any user registration requirement.

3. Disclaimer of Warranties & Estimates

• Calculator results are accurate, complete, current, or error-free
• The Service will meet your specific requirements or expectations
• Any specific vehicle qualifies for any federal or state credit
• Your actual tax savings will match or approximate the estimates provided
• State rebate programs listed are currently funded, accepting applications, or available to you
• The Site will be uninterrupted, timely, secure, or free from technical errors

Tax laws and incentive programs change frequently. IRS rules under the Inflation Reduction Act have been subject to ongoing guidance updates, and state programs may be modified, suspended, or discontinued at any time without notice to us.

MyEVCred is not a licensed tax advisor, financial advisor, attorney, or CPA. Nothing on this Site or provided through the Service constitutes financial, tax, investment, or legal advice.

Specifically:

• Calculator outputs are mathematical estimates based on publicly available IRS guidelines and should not be relied upon for tax filing purposes
• Eligibility for the federal EV credit depends on your individual tax situation, including your actual tax liability for the year — a factor our calculator cannot fully determine
• Vehicle qualification under the IRS's critical mineral, battery component, and North American assembly requirements changes frequently and must be verified independently

Public-domain information about IRS tax credits, state programs, and vehicle eligibility is factual in nature and not subject to copyright; however, our original expression, presentation, and editorial content is proprietary.

Nothing in these Terms grants you any right to use our trademarks, trade names, logos, or brand elements without express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYEVCRED, ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of money, profits, savings, revenue, or business arising from reliance on calculator estimates
• Any tax penalties, interest, or assessments resulting from reliance on information provided on this Site
• Costs of purchasing an electric vehicle based on estimated credits that prove inaccurate
• Loss of data or any intangible losses

IN NO EVENT SHALL MYEVCRED'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED $100 USD, REGARDLESS OF THE FORM OF ACTION OR BASIS OF THE CLAIM.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless MyEVCred and its operators from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of courts in the United States, without regard to conflict of law provisions.

If you are accessing the Site from the European Union or United Kingdom, you may have additional rights under GDPR or UK GDPR, as described in our Privacy Policy. These Terms do not limit any rights you have under mandatory consumer protection laws in your jurisdiction.
